Welcome to the hamptonandastley.com website terms and conditions for use.

These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out below.

Before you place an order, if you have any questions relating to these terms and conditions, please contact our customer service team by email, hello@hamptonandastley.com or use the Contact Us form on our website (www.hamptonandastley.com).

Order confirmation

The technical steps required to create the contract between you and us are as follows:

  • You place the order for your products on the website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the website.
  • We will send you an order confirmation email detailing the products you have ordered. This is not an order acceptance. It is important that you enter the correct e-mail address when placing your order as we will use this email address to send order updates and to contact you if necessary. We recommend saving this email to facilitate any contact with customer service you may have in the future. The order confirmation email also serves as a receipt and a guarantee of proof of purchase.
  • Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the products ordered unless we have notified you that we do not accept your order, or you have cancelled your order.
  • Your credit/debit card will be charged at the point of placing the order.

Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock
  • Our inability to obtain authorisation for your payment
  • The identification of a pricing or product description error

If a price is incorrect our customer service team will contact you as we may need to cancel the purchase and refund any amount paid. 

We may change our prices at any point but any requests on out of stock products will be honoured at the correct price they were at when the enquiry was first made. Any returned items will always be refunded at the price they were purchased for.

Payment

Hampton and Astley accept credit or debit cards. We are pleased to confirm there is no extra charge for card payments. We also accept payment through PayPal.

Payment by card

Payment can be made with Visa, AMEX or MasterCard securely over the Internet. Your payment is handled by Stripe with secure encryption. Stripe is certified as a PCI Level 1 Service Provider. This is the most stringent level of certification available in the payments industry. Your card details are sent directly to the bank and cannot be read or accessed by anyone other than your bank. When paying by credit / debit card conditions apply as soon as the card transaction is approved. If no payment has been received after submitting your order, Hampton and Astley may automatically cancel your order and inform you of this.

Promotion codes

Promotion codes can be entered during the checkout process or by using links that we can provide. Please contact our customer service team, hello@hamptonandastley.com or by using the Contact Us form on our website if the product you wish to purchase is currently out of stock.

Taxes

All prices shown on the Hampton and Astley website, www.hamptonandastley.com, are including VAT.

Personal information

When shopping with Hampton and Astley we will save some of your data to complete your purchase. Hampton and Astley treats all personal information as confidential. You have the right to request access to your data and if there is anything wrong it can be changed or removed. Hampton and Astley may also use cookies to improve your experience of the website.

Product

Hampton and Astley may adjust prices and change product information such as product images and offers. The product images and information text available reflect the product as much as possible. We cannot guarantee that all pictures accurately reflect the true appearance of the product as pictures may differ depending on the colour settings in your computer. 

Delivery and cancellations

Hampton and Astley ships worldwide. Deliveries are made in cooperation with the postal services and their partners. You have the right to cancel purchases within 14 days of receipt of the goods. The easiest way to do this is to contact our customer service team, hello@hamptonandastley.com or by using the Contact Us form on the Hampton and Astley website and return the goods to us (making sure they are returned in accordance with the Returns Policy).

Unfortunately, Hampton and Astley are unable to cover the return postage cost for cancellations. We recommend using a delivery service that insures the value of the goods as Hampton and Astley cannot take responsibility for any items lost during the return shipping. The cancellation is not valid until you have confirmed with the Hampton and Astley customer service team by email.

Whilst Hampton and Astley endeavours to deliver your order within 3-5 working days sometimes, for reasons beyond our control, we are unable to achieve this for example due to bad weather, failed or delayed delivery from our suppliers, failed collection or delivery from our courier. If we can foresee that any of these issues will delay your order Hampton and Astley will contact you as soon as possible to confirm if you still wish to keep your order. If you prefer to cancel, the order will be cancelled and refunded immediately. If you would like to keep your order, it will be dispatched as soon as the item becomes available. Please kindly note that we can only dispatch your order once all the items on the order are available. As the above issues are beyond our control unfortunately Hampton and Astley are unable to offer any compensation for the delay.

If you wish to cancel your order and it has already been dispatched, unfortunately we cannot recall the order and kindly ask that you return the order to us (making sure items are returned in accordance with the Returns Policy).

For failed deliveries where the item is returned to us by the courier there is a £7 surcharge in addition to the postage charge.

Returns

You have the right to return any products you have purchased directly from our website within 30 days of receiving your order. Any items returned to us must be in their original condition, unwashed and unused – if they’re not, we may be unable to accept them.

Before attempting to return an order, please contact our customer service team who will be happy to help, hello@hamptonandastley.com or use the Contact Us form on our website and provide your order number which can be found on your order confirmation email. This will help us to process your return as quickly as possible.

We are more than happy to refund postage costs to return an item where the return is required due to our error. For instance, if we sent the wrong item or if the item is damaged or faulty. Unfortunately, we cannot refund postage costs to return items which are unwanted or no longer required. We recommend using a delivery service that insures the value of the goods as Hampton and Astley is unable to take responsibility for any items lost during the return shipping.

Defective products and complaints

We kindly ask that you carefully check your products once receiving your order to see if any products are damaged or incorrect. If your product is damaged in transport, whether the damage is visible or hidden, please report this as soon as possible to the Hampton and Astley customer service team, hello@hamptonandastley.com or use the Contact Us form on our website. You have 30 days from receiving your order to report any damages or an incorrect order.

Any complaints should be made to our customer service team, hello@hamptonandastley.com, through the Contact Us form on our website or by using the blue 'Message Us' button in the bottom right corner. Please kindly supply the order number and the reason for the complaint and we will get back to you within 24 hours and often, a lot sooner.

Hampton and Astley will be happy to replace defective products within six months. If the item is unavailable or has been discontinued, the customer will receive a refund including the postage costs for the defective item. Defective products returned to Hampton and Astley should be treated as if they were faultless and packaged in such a way that it cannot be damaged during transit. In the case that a returned product has no errors or faults, Hampton and Astley will issue a refund for the product only.

Intellectual property rights

All intellectual property rights, such as trademarks and copyright, on the website and in the material published on it are owned by Hampton and Astley. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Hampton and Astley.

Fraud

All fraudulent activity is reported to the authorities and Hampton and Astley reserves the right to cancel the purchase if any suspicion is raised. 

SMS / Text messaging service

The Hampton and Astley mobile message service (the "Service") is operated by Hampton and Astley Limited (“Hampton and Astley”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Hampton and Astley’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Hampton and Astley through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Hampton and Astley. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Hampton or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Hampton and Astley mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
